Kid-Friendly Summary (Read this first!)

  • What is GradeAid? It is an AI tutor that helps you learn.
  • Safety First: We use Google Gemini (a smart robot) to answer your questions. We make sure the robot doesn't know your name or email — we keep you anonymous.
  • The Rules: Be nice. Don't bully. Don't use the AI to cheat on tests. Do not try to trick the coin system.
  • Age Check: If you are under 13, your parent must create the account for you.
  • Mistakes: The AI is smart, but it can make mistakes. Always check with your real teacher.
  • Your Data: You can ask us to delete your account and data at any time by emailing privacy@gradeaid.ai.
  • No Ads: We do not show you personalized ads or try to sell you things.

1. Introduction

Welcome to GradeAid! GradeAid is a service provided by GradeAid (DK), CVR 45882411 (“we,” “us,” or “our”). We are dedicated to helping kids learn for real — no shortcuts, no cheating — while helping families find peace at home regarding homework.

By creating an account or using our AI tutor services, you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you (the “User”) and GradeAid.

2. Eligibility & Parental Responsibility

Protecting children's safety is paramount to us. We adhere to the General Data Protection Regulation (GDPR) and the Danish Data Protection Act (Databeskyttelsesloven) regarding the digital consent age.

2.1 Users Under 13

You are not permitted to create an account if you are under 13 years of age. A parent or legal guardian (forældremyndighedsindehaver) must create an account and add a child profile on your behalf.

2.2 Parental Responsibility

If you are a parent or legal guardian, you are responsible for:

  • Giving explicit consent for your child to use the service.
  • Supervising your child's use of GradeAid.
  • Supervising that the “About Me” or chat inputs do not contain sensitive personal information (like home addresses).

2.3 Users Aged 13 or Older

Users aged 13 or older may create an account and consent to data processing independently, in accordance with Databeskyttelsesloven § 6, stk. 2.

2.4 Household Use

The service is for you and your household, which includes your spouse/partner and any children you have parental responsibility for.

3. The Service & AI Technology

3.1 Service Description

GradeAid provides an AI-powered educational interface designed to assist students with schoolwork, explain complex concepts, and offer study support.

3.2 Use of Google Gemini

To provide this service, we use the Google Gemini Large Language Model (LLM) as a third-party sub-processor.

  • Anonymization: Before we send your child's question to Google, we strip away all personal identifiers and PII. Google receives the content of the educational question, but not the identity of the child asking it.
  • No Training on Data: GradeAid contractually prohibits Google Gemini from using any submitted educational questions or chat logs to train its general AI models.

3.3 Tailored Learning & Service Improvement

To provide a personalized educational experience, the AI utilizes specific inputs including the child's Nickname, Grade Level, and the content of Chat Interactions.

3.4 Gamification and Virtual Rewards

GradeAid utilizes a “Gamification” system (e.g., coins for virtual pets) to encourage study habits.

  • No Monetary Value: Virtual coins, pets, or other digital rewards have no real-world monetary value.
  • Non-Transferable: Virtual items are non-transferable and non-refundable.
  • Revocation: We reserve the right to revoke virtual rewards at any time.

3.5 Accuracy Disclaimer

Generative AI can sometimes produce confident but factually incorrect answers (“hallucinations”). GradeAid is a tool for support, not a substitute for a certified human teacher.

3.6 EU AI Act

We acknowledge that AI systems used in education may be classified as “High-Risk” under European AI regulations. GradeAid is committed to operating under the highest safety and quality standards.

4. Data Protection & Privacy

4.1 Information We Collect

  • Parent's email address
  • Child's data: Nickname, grade level, and chat interactions
  • Cookies for login sessions

4.2 Special Category Data

You strictly agree not to input Special Category Data (GDPR Article 9), such as medical diagnoses or health data, into the chat interface.

4.3 Legal Basis for Processing

  • Consent: By creating an account and ticking the consent checkbox (Databeskyttelsesloven § 6, stk. 2-3).
  • Legitimate Interest: To improve AI safety.

4.4 Data Retention

Chat logs are retained for a maximum of 90 days before permanent deletion or full anonymization.

4.5 Your Rights (GDPR)

Contact privacy@gradeaid.ai to exercise:

  • Right to Access: Get a copy of your data.
  • Right to Erasure: Request permanent deletion.
  • Right to Portability: Get your data in JSON/PDF.
  • Right to Restrict Processing: Request limitation of processing.
  • Right to Withdraw Consent: Withdraw at any time without affecting prior processing.
  • Right Regarding Automated Decisions: Not to be subject to a purely automated decision without human involvement (GDPR Art. 22).
  • Right to Complain: Lodge a complaint with Datatilsynet (datatilsynet.dk).

5. Advertising and Sponsored Content

GradeAid does not display advertising or sponsored content to children on the platform. We do not use personal data for profiling or targeted marketing. No tracking or marketing cookies are used in the child's experience. The platform does not contain direct purchase calls to children.

6. User Code of Conduct

You agree strictly NOT to:

  • Bully or Harass: Use the platform for mean, threatening, or abusive behavior.
  • Cheat: Use the AI to write essays or solve exams that you pass off as your own work.
  • Exploit Gamification: Hack or manipulate the rewards system.
  • Jailbreak: Attempt to manipulate the AI into generating illegal, sexual, or violent content.
  • Share Accounts: Share login credentials with others outside your household.

GradeAid reserves the right to suspend or terminate any account that violates these rules.

7. Intellectual Property

  • Our Rights: GradeAid, the logo, the software code, and the system prompts are our intellectual property.
  • Your Rights: You retain the rights to your text inputs. You grant us a worldwide, non-exclusive license to use them solely to generate AI responses.

8. Limitation of Liability

The Service is provided “AS IS” and “AS AVAILABLE.” GradeAid shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the service. This limitation does not affect your statutory rights under Danish or EU law.

9. International Transfers

Your anonymized data may be processed by Google servers outside the EEA. We transfer personal data to the United States on the basis of the EU-U.S. Data Privacy Framework (DPF), where the recipient is DPF-certified. Standard Contractual Clauses (SCCs) are used as a supplementary safeguard where applicable.

10. Modifications to Terms

We may update these Terms from time to time. The version number and date are shown at the top of this document. Significant changes will be notified via email at least 30 days before they take effect. If you do not agree to the changes, you may delete your account. Where consent is the legal basis for processing, material changes affecting data processing will require renewed consent.

11. Governing Law & Dispute Resolution

  • Governing Law: Laws of Denmark.
  • Complaints: Lodge a complaint with the Danish Data Protection Agency (Datatilsynet).
  • Venue: City Court of Copenhagen (Københavns Byret).
  • ODR Platform: EU Online Dispute Resolution
